Terms of Service

1. Acceptance of Terms

By accessing and using GiBoard, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by these terms, please do not use this service.

2. Service Description

GiBoard is a marketplace platform that connects buyers and sellers in Gibraltar and surrounding regions. We provide a venue for users to list items, properties, and services, and to communicate with potential buyers. GiBoard does not take part in transactions and is not responsible for the quality, safety, or legality of items listed, the accuracy of listings, or the ability of users to complete transactions.

3. User Accounts

When you create an account with us, you must:

• Provide information that is accurate, complete, and current at all times
• Be at least 16 years of age
• Provide a valid phone number for account verification
• Safeguard your password and account credentials
• Take responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

4. Listings and Trading

When creating listings on GiBoard, you agree to:

• Provide accurate and truthful descriptions of items, properties, or services
• Own or have legal authority to sell the items or properties listed
• Comply with all applicable local, national, and international laws and regulations
• Not post duplicate or spam listings across multiple categories
• Update or remove listings promptly when items become unavailable
• Not manipulate pricing, views, or engagement metrics

5. Real Estate Transactions

For real estate listings, additional terms apply: All property information must be verified and accurate. Users must have proper licensing or authorization to list properties for sale or rent. GiBoard is not a licensed real estate agent and does not provide real estate services. All transactions are between users, and professional legal and financial advice is recommended.

6. Intellectual Property and Content Rights

When you upload content to GiBoard:

• You retain ownership of your content (photos, descriptions, etc.)
• You grant GiBoard a non-exclusive license to display, distribute, and promote your content on our platform
• You warrant that you own or have rights to all content you upload
• You will not upload content that infringes on trademarks, copyrights, or other intellectual property rights
• We automatically remove EXIF data and metadata from uploaded photos for privacy protection

7. Payments and Fees

GiBoard may charge fees for certain services:

• Premium listing features (highlighting, featured placement, top positioning)
• All fees are in GBP or EUR as applicable to your location
• Payments are processed securely through third-party payment processors
• Refunds are subject to our refund policy and applicable laws
• EU users have a 14-day right of withdrawal for digital services (where applicable)

8. Communication and Chat

Our chat system is provided for legitimate business communication between buyers and sellers:

• Users must not use the chat system for harassment, spam, or inappropriate content
• All chat communications may be monitored for safety and compliance purposes
• Chat messages are retained for 2 years or until account deletion
• Sharing external contact information is at your own risk

9. Content Moderation and Automated Systems

GiBoard uses a combination of automated systems and human review to moderate content. We may use algorithms to detect spam, fraud, inappropriate content, or terms violations. Automated systems may flag or remove content, but human review is available for appeals. We reserve the right to monitor, edit, or remove any content that violates these terms without prior notice.

If your content is removed and you believe this was in error, you can appeal by contacting support@giboard.gi.

10. Prohibited Uses

You may not use our service for any of the following purposes:

• For any unlawful purpose or to solicit others to perform unlawful acts
• To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
• To infringe upon or violate our intellectual property rights or the intellectual property rights of others
• To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
• To submit false or misleading information or to impersonate any person or entity
• To sell illegal items, stolen goods, or items that violate intellectual property rights
• To engage in price manipulation, bid shilling, or other fraudulent trading practices
• To use automated tools (bots, scrapers) without permission
• To attempt to gain unauthorized access to our systems or other users' accounts

11. Prohibited Items and Services

The following items and services are strictly prohibited on GiBoard. Violations will result in immediate content removal, account suspension, and may be reported to law enforcement:

Drugs and Controlled Substances

• Illegal drugs including cocaine, heroin, MDMA/ecstasy, LSD, methamphetamine, ketamine, GHB
• Cannabis, marijuana, weed, hash (regardless of local laws)
• Synthetic drugs and research chemicals (3-MMC, 4-MMC, spice, bath salts)
• Prescription medications without proper license (Xanax, Valium, Adderall, opioids)
• Weight loss medications requiring prescription (Ozempic, Mounjaro, Wegovy, Saxenda)
• Anabolic steroids and performance-enhancing drugs
• Drug paraphernalia (pipes, bongs, syringes for drug use)

Weapons and Dangerous Items

• Firearms, guns, and ammunition
• Explosives, fireworks, and incendiary devices
• Combat knives, switchblades, and concealed weapons
• Tasers, stun guns, and pepper spray
• Crossbows and air guns
• Military equipment and body armor
• Instructions for creating weapons or explosives

Illegal Services and Fraud

• Fake documents (IDs, passports, diplomas, certificates)
• Stolen goods or property
• Hacking services, malware, or stolen data
• Money laundering or financial fraud schemes
• Counterfeit products and currency
• Pyramid schemes and scams
• Identity theft services
• Unlicensed financial, legal, or medical services

Adult and Inappropriate Content

• Sexual services or escort services
• Pornographic material
• Human trafficking (reported to authorities)
• Child exploitation material (immediately reported to authorities)
• Dating or matchmaking services

Other Prohibited Items

• Protected wildlife, endangered species, or animal parts
• Human organs or body parts
• Hazardous materials and chemicals
• Unlicensed gambling services
• Items promoting hate speech or discrimination
• Nazi memorabilia and extremist content
• Tobacco products sold to minors
• Alcohol without proper licensing

12. Content and Reviews

Users are solely responsible for the content they post, including listings, reviews, and messages. Reviews must be honest and based on actual experiences. Fake or incentivized reviews are prohibited. We reserve the right to remove reviews that violate our policies or applicable laws.

13. Fraud and Scam Protection

While we take measures to prevent fraud, users must exercise caution:

• Never send money via wire transfer or untraceable payment methods to unknown parties
• Meet in public places for in-person transactions
• Verify property ownership and authenticity before making payments
• Report suspicious activity to support@giboard.gi immediately
• GiBoard is not liable for fraudulent transactions between users

14. Limitation of Liability and Disclaimers

GiBoard acts as a platform connecting buyers and sellers. We are not party to transactions between users and are not responsible for the quality, safety, legality, or accuracy of listings. The service is provided "as-is" without warranties of any kind. Users engage in transactions at their own risk and should exercise appropriate caution and due diligence.

To the maximum extent permitted by law, GiBoard shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service.

15. EU Consumer Rights

For users in the European Union and Spain, additional consumer protections apply:

• 14-day right of withdrawal for digital services (where applicable)
• Right to clear and transparent pricing information
• Access to alternative dispute resolution mechanisms
• Protection under EU consumer protection directives

16. Dispute Resolution

In the event of disputes between users, we encourage amicable resolution. For disputes involving GiBoard, users may access alternative dispute resolution through the European Commission's ODR platform (for EU consumers) or through Gibraltar's dispute resolution mechanisms. Nothing in these terms prevents you from bringing issues to the attention of relevant consumer protection authorities.

17. Governing Law

These terms are governed by the laws of Gibraltar and the United Kingdom. For users in Spain and the EU, mandatory consumer protection laws of your country of residence also apply. Any disputes will be resolved through the courts of Gibraltar or through alternative dispute resolution methods, without prejudice to mandatory consumer protection rights.

18. Termination and Account Suspension

We may terminate or suspend your account immediately, without prior notice, for violations of these terms, illegal activity, or fraud. Upon termination, your right to use the service will immediately cease, and outstanding listings will be removed. You may also delete your account at any time from your account settings. Data retention after termination follows our Privacy Policy.

19. Account Bans and Appeals

GiBoard enforces a graduated system of account penalties:

• First violation: Warning and content removal
• Second violation: Temporary suspension (7-30 days)
• Severe or repeated violations: Permanent account ban
• Illegal content (drugs, weapons, fraud): Immediate permanent ban without warning

To appeal a ban, email support@giboard.gi with your account details and explanation. Appeals are reviewed within 14 business days. Bans for illegal content are not eligible for appeal.

20. Changes to Terms

We reserve the right to update these terms at any time. Users will be notified of significant changes via email or platform notification at least 30 days before taking effect. Continued use of the service after changes constitutes acceptance of the new terms. You may terminate your account if you do not agree with the updated terms.

21. Severability

If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
